San Marcos Police, Fire and EMS responded to an auto-pedestrian incident Friday, June 15 at approximately 7:15 p.m. at the intersection of Riverside at the west IH 35 Access.

Upon arrival, officers found that a 48-year-old male from Kyle had been struck by a 1998 Toyota van. EMS arrived and determined that the male was deceased.

Witnesses reported that the van had jumped the curb and struck the pedestrian, who had been on the sidewalk. A passenger in the van fled on foot from the accident scene and was taken into custody nearby by officers from Texas State University Police.

The driver of the van fled the scene in the automobile and turned right onto the turnaround underneath IH 35 at the San Marcos River. The driver lost control of the vehicle on the turnaround, jumped another curb and struck a tree.

The driver was helped out of the vehicle and held at the scene by witnesses. He was subsequently taken into custody by San Marcos police officers.

The pedestrian was identified as Tyrus Dennis Piano (DOB 08-14-1969) of Kyle, Texas. He was pronounced dead by Justice of the Peace JoAnne Prado.

The driver of the van was taken to Central Texas Medical Center where officers took a blood sample pursuant to a blood search warrant. He was booked into the Hays County Jail on a charge of Intoxication Manslaughter and awaits magistrate.
