City Of Buda Takes Next Action Against GrubTubs For Violation Of New Odor Nuisance Ordinance

BUDA, TX —  The City of Buda has taken the next action against GrubTubs Inc., for violation of the City’s Odor Nuisance Ordinance. The Code Enforcement Officer has filed a case in Municipal Court regarding the infractions.

The business is also on the Code Enforcement Officer’s daily enforcement route and the code officer has communicated with the owner of the business, regarding multiple complaints from citizens. 

Citizens can file a Civilian Municipal Court complaint at the City of Buda Municipal Court Office located at 405 East Loop Street, Building 100. The complaint form is a sworn statement that will ask for your name, the date of the offense, and the location of the offense. Completion of the form may require that you testify in court. Please note that the civilian complaint is not a requirement.

Citizens who do not want to file a Civilian Municipal Court complaint may still submit statements to our Code Enforcement Officer at  codeenforcement@ci.buda.tx.us, or online at https://www.ci.buda.tx.us/RequestTracker.aspx under the code enforcement tab.

The City ordinance only allows the City to enforce odor nuisances. Other environmental issues should be filed with Hays County or the TCEQ (Texas Commission on Environmental Quality). Please contact the Hays County Development Services Department at 512-393-2150. Below is a timeline of the City’s actions taken after the Buda City Council passed the Odor Nuisance Ordinance on May 7, 2019:  

  • City Attorney sent violation notice on May 23, 2019.
  • Code Enforcement sent violation on May 24, 2019.
  • Staff and City Attorney met with the business on June 12, 2019. At that meeting, the City Attorney
    gave the business 14 days to submit a Continuous Quality Improvement Report. The report has been submitted and is being reviewed by the City Attorney.
  • Hays County and Texas Commission on Environmental Quality (TCEQ) are also investigating.
