Police Arrest Third Suspect In June 5 Capital Murder Case

A third person will be charged in connection with the June 5 murder of DeMarcus Allen at the Village of Telluride Apartments.

Chelsy Alyce Mistretta (08/18/1997) was arrested in Bryan, TX after investigators discovered she was in the vehicle with Lapear Willrich and Jon Jervis when they fled the scene the day of the murder.

At this time, San Marcos Police Detectives are awaiting the extradition of Mistretta back to Hays County.

Previous Release June 20: Police Arrest Two in Connection with June 5 Capital Murder

Two men have been arrested in connection with the murder that happened at the Village on Telluride on June 5. Jon Hunter Jervis (07/29/1995) and Lapear O’Neal Willrich (08/17/1993) have both been charged with Capital Murder.

San Marcos Police Department investigators worked tirelessly and gathered a large amount of evidence from various sources including surveillance video.

SMPD was able to determine that there were two offenders involved in this homicide, and the entire murder was recorded by a video camera mounted inside the apartment of the crime scene.

Additionally, other surveillance videos and witness statements led SMPD to determine the vehicle used by the offenders was a white/cream, 1994 to 1996 Cadillac Deville.

On Tuesday, June 18, SMPD Criminal Investigation Division received information that a similar vehicle was registered to a resident of Giddings, Texas and it was listed for sale.

SMPD further learned that the vehicle was recently involved in an arrest by the Bryan Police Department. During that incident, Bryan PD arrested Jervis from the vehicle for several warrants. When SMPD was made aware of Jervis’ arrest, he was still incarcerated in the Brazos County Jail.

In the evening of June 18, several SMPD detectives traveled to the Brazos County Jail and gathered further evidence of Jervis’ involvement in the Capital Murder, including the fact that Jervis had a healing gunshot wound that he sustained during the June 5 offense.

Hays County Justice of the Peace Maggie H. Moreno issued an arrest warrant for Capital Murder, and the warrant was served on Jervis at the Brazos County Jail where he awaits extradition.

Continued investigative work on Wednesday, June 19, led detectives to Willrich, a resident of Giddings, as the second offender in this case. Hays County Justice of the Peace Maggie H. Moreno issued an arrest warrant for capital murder, and Willrich was arrested by members of SMPD in Giddings.

Willrich was transported immediately to the Hays County Jail. At the time of his arrest, it was learned that he also had a healing gunshot wound sustained during the June 5 offense.

“The Criminal Investigations Division has been working non-stop to solve this case quickly,” said SMPD Police Chief Chase Stapp. “We also want to thank the Texas Rangers and the Bryan and Giddings Police Departments for their assistance in helping arrest these two men.”

At this time the SMPD is awaiting Jervis’ extradition, and Willrich remains in the Hays County Jail. The investigation into this crime continues.

Original Release June 5: Police Investigating Homicide at Village on Telluride

San Marcos Police are investigating a homicide that occurred today at the Village on Telluride in San Marcos. 

On Wednesday, June 5, 2019, at approximately 7:10 AM, officers were called to the 300 block of Telluride to a report of a burglary of a habitation.  A resident of the complex reported finding a loose dog and followed the dog to an apartment.  Upon arriving at the apartment, the resident observed that the door was kicked in and contacted SMPD. 

Officers arrived and found Demarcus Trey Allen (04/25/1996) of Pasadena, TX, deceased from an apparent gunshot wound. Justice of the Peace Maggie H. Moreno pronounced Allen deceased at the scene at 8:40 AM. 

Two additional individuals that were upstairs in the apartment and one additional roommate are being interviewed by detectives with the SMPD Criminal Investigation Division.

This is the fifth homicide for San Marcos in 2019 with the four prior incidents including, Feb. 13, Aaron Peterman; Feb. 17, Brihana Landrum; Apr. 6, Nicholas White; May 5, Connor Shannon.
