EXECUTIVE SESSION

1. 5:00PM
Executive Session in accordance with Section § 551.087 of the Texas Government Code: Economic Development – receive a briefing from Greater San Marcos Partnership President Adriana Cruz and deliberate regarding the potential offer of Economic Development Incentives to Project IQ and Project Orange; and in accordance with Section §551.072 of the Texas Government Code: Real Property – to receive an update regarding City real estate comprised of three tracts of land known as the “Leah Tract,” comprised of a 1.378 acre tract out of the J.M. Veramendi Survey No. 1, Abstract No. 17, a 25.05 acre tract, being Lot 1 of the Cottonwood Parkway Addition and a 1.36 acre tract, being Lot 10A of the Municipal Airport Subdivision.

2. Consider adoption or direction to Staff on matters discussed in Executive Session.

NOTE: The City Council may adjourn into Executive Session to consider any item listed on this  agenda if a matter is raised that is appropriate for Executive Session discussion. An announcement  will be made of the basis for the Executive Session discussion. The City Council may also publicly
discuss any item listed on the agenda for Executive Session.

3. Receive a Staff presentation regarding the Hopkins and Charles AustinCrosswalk Improvements, and provide direction to Staff.

4. Receive a Staff presentation and hold discussion regarding a possible amendment to Chapter 74 of the City Code to include a new Article 6 that allows for Sidewalk Cafes, Parklets, and Similar Special Uses of Public Rights-of-way, and provide direction to Staff.

CONSENT AGENDA

THE FOLLOWING ORDINANCES, RESOLUTIONS AND OTHER ITEMS MAY BE ACTED UPON BY ONE MOTION. NO SEPARATE DISCUSSION OR ACTION ON ANY OF THE ITEMS IS NECESSARY UNLESS DESIRED BY A COUNCIL MEMBER OR A CITIZEN, IN WHICH EVENT THE ITEM SHALL BE CONSIDERED IN ITS NORMAL SEQUENCE AFTER THE ITEMS NOT REQUIRING SEPARATE DISCUSSION HAVE BEEN ACTED UPON BY A SINGLE MOTION.

5. Consider approval of the October 6, 2014, Regular Meeting Minutes; and consider the approval of the correction of a typographical error in the January 17, 2012, Regular Meeting Minutes.

6. Consider approval of Ordinance 2014-53, on the second of two readings, creating an all-way stop sign traffic control device at the intersection of Old Settlers Drive and Blanco Vista Boulevard under Section 82.066 of the San Marcos City Code and authorizing City Traffic Engineer to install all-way stop signs; amending the Traffic Register to reflect the all-way stop; and providing for an effective date.

7. Consider approval of Ordinance 2014-54, on the second of two readings, amending the Traffic Register maintained under Section 82.067 of the San Marcos City Code by reducing the speed limit from 35 miles per hour to 30 miles per hour on FM 2439 (Hunter Road) from mile post 0.660 (west of Johnson Street) to mile post 0.998 (San Antonio Street) and reducing the speed limit from 45 miles per hour to 35 miles per hour from mile post 0.998 (San Antonio Street) to mile post 1.531 (Wonder World Drive); and including procedural provisions.

8. Consider approval of Ordinance 2014-55, on the second of two readings, creating a Designated Permit Area under Section 82.189 of the San Marcos City Code that allows parking by permit only between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, for the 100 to
200 block of Mandalay Lane (from the north dead end to west Bluebonnet Drive); amending the Traffic Register to reflect such Designated Permit Area; and providing for an effective date.

9. Consider approval of Ordinance 2014-56, on the second of two readings, creating a Designated Permit Area under Section 82.189 of the San Marcos City Code that allows parking by permit only for the 600 block of Lindsey Street (between Scott Street and Burleson Street) and for the 600 block of Rogers Street (between Scott Street and Burleson Street); amending the Traffic Register to reflect such Designated Permit Area; and providing for an effective date.

10. Consider approval of Ordinance 2014-57, on the second of two readings, designating a No Semi-Trailer Parking Zone at all times on both sides of the 1900 blocks of Dutton Drive (from Wonder World Drive to the east property line of 1909 Dutton Drive); amending the Traffic Register maintained under Section 82.067 of the San Marcos City Code to reflect such designation; and including procedural provisions.

11. Consider approval of Ordinance 2014-58, on the second of two readings, designating a No Parking, No Standing, No Stopping, Tow-Away Zone on the north corner of the Guadalupe Street and Woods Street Intersection; and amending the Traffic Register maintained under Section 82.067 of the San Marcos City Code to reflect such designation; and including procedural provisions.

12. Consider approval of Ordinance 2014-59, on the second of two readings, designating a No Parking Tow-Away Zone on the west side of the 400 block of Comanche Street (from Lindsey Street to Pat Garrison Street) and amending the Traffic Register maintained under Section 82.067 of the San Marcos City Code to reflect such designation; and including procedural provisions.

13. Consider approval of Ordinance 2014-60, on the second of two readings, amending the hours for use of automatic sprinkler irrigation systems during stage 1, stage 2, and stage 3 of the Drought Response Plan; providing a savings clause; providing for the repeal of any conflicting provisions; and providing an effective date.

14. Consider approval of Resolution 2014-145R approving a Reimbursement Agreement with Enterprise Texas Pipeline, L.L.C. providing for the City to reimburse the costs incurred to relocate gas pipeline facilities in the estimated amount of $ 785,000.00 in connection with the Willow Springs Creek Drainage Improvements Project; authorizing the City Manager to execute said agreement; and declaring an effective date.

15. Consider approval of Resolution 2014-146R awarding an IDIQ (Indefinite Delivery/Indefinite Quantity) Master Contract for surface/edge milling to Aaron Concrete Contractors, LP in the estimated annual amount of $300,850.00 contingent upon the bidder’s timely submission of sufficient bonds and insurance in accordance with the City’s bid documents for the project; authorizing the City Manager or his designee to execute the contract documents on behalf of the City; and declaring an effective date.

16. Consider approval of Resolution 2014-147R approving a contract between the City and Hays County for the City’s provision of Public Library Services to Hays County Residents; authorizing the City Manager or his designee to execute the contract on behalf of the City; and declaring an effective date.

17. Consider approval of Resolution 2014-148R approving an Interlocal Agreement between the City of San Marcos and the San Marcos Consolidated Independent School District for the City’s provision of Police Officers to the School District to serve as School Resource Officers; authorizing the City Manager or his designee to execute this agreement on behalf of the City; and declaring an effective date.

PUBLIC HEARINGS – 7:00 PM

18. 7:00 PM Receive a Staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2014-64 approving a request by High Pointe Communities for an amendment to the Preferred Scenario Map of the City’s Comprehensive Plan to change the Land Use Designation for a 158.4 acre, more or less, tract of land out of the William H. Van Horn Survey, located between south IH-35 and an LCRA electric easement and south of Posey Road (Trace); and including procedural provisions; and consider approval of Ordinance 2014-64, on the first of two readings.

19. 7:00 PM Receive a Staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2014-65 approving a request by Flying TZ, LP for an amendment to the Preferred Scenario Map of the City’s Comprehensive Plan to change the Land Use Designation for a 92 acre, more or less, tract of land out of the Samuel Craft Sr. Survey, located between south IH-35 and Old Bastrop Highway and south of Posey Road (Las Colinas); and including procedural provisions; and consider approval of Ordinance 2014-65, on the first of two readings.

20. 7:00 PM Receive a Staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2014-63 approving a request by ETR Development Consulting, LLC for an amendment to the Preferred Scenario Map of the City ’s Comprehensive Plan to change the Land Use Designation for a six acre, more or less, tract of land out of the J.M. Veramendi Survey No.1, located at the intersection of IH-35 and Luciano Flores Boulevard (Thornton) from an area of stability to a high intensity zone, while preserving the open space designation for the floodway and water quality zone, as may be amended; and including procedural provisions; and consider approval of Ordinance 2014-63, on the first of two readings.

NON-CONSENT AGENDA

21. Consider approval of Ordinance 2014-62, on the first of two readings, setting the rate for Wholesale Water Treatment at the City’s Surface Water Treatment Plant at $0.4020 per thousand gallons; and including procedural provisions.

22. Consider approval of Ordinance 2014-66, on the first of two readings, designating a No Parking/Tow-Away Zone at all times on both sides of the 400 block of Fredericksburg Street (from Lindsey Street To Pat Garrison Street) and amending the Traffic Register maintained under Section 82.067 of the San Marcos City Code to reflect such designation; and including procedural provisions.

23. Consider approval of Ordinance 2014-67, on the first of two readings, authorizing the installation of speed cushions in both directions in the 100 through 400 blocks of Hughson Drive (from Old Ranch Road 12 to Craddock Avenue); and including procedural provisions.

24. Consider approval of Resolution 2014-149R authorizing and creating the Whisper Public Improvement District in accordance with Chapter 372 of the Texas Local Government Code.

25. Consider approval of Resolution 2014-150R approving a lease with Martin Marietta Materials Southwest, Inc., leasing the City’s right to withdraw 885 acre feet of water from the Edwards Aquifer during the lease term beginning on January 1, 2014 and ending on December 31, 2014 in exchange for the payment to the City of $347,805.00 and declaring an effective date.

26. Hold discussion regarding the composition of the San Marcos Commission on Children and Youth, and provide direction to Staff.
