SAN MARCOS – During a work session and their regular meeting on Tuesday, January 4, 2022, the San Marcos City Council will discuss the lawsuit against the city and multiple city officials due to the “Trump Train” incident on Interstate 35 late Oct. 2020.
In executive session, council members will receive a briefing on pending litigation in the court case between Eric Cervini, Wendy Davis, David Gins and Timothy Holloway versus San Marcos Director of Public Safety Chase Stapp, San Marcos assistant police chief Brandon Winkenwerder, San Marcos police corporal Matthew Daenzer and the City of San Marcos.
In October 2020, just before the general election, a Biden-Harris campaign bus passed through San Marcos on Interstate 35 when several trump supporters nearly ran the bus off the road.
Transcribed recordings filed in the amended lawsuit show that San Marcos law enforcement leaders chose not to provide the bus with a police escort multiple times, even when contacted for help by campaign staffers and other drivers on the interstate concerned with the reckless driving.
The lawsuit states that the defendants failed “to take reasonable steps to prevent planned acts of violent political intimidation.”
According to the lawsuit, the plaintiffs ask for compensatory and punitive damages and legal fees.
Other items to be discussed in the executive session include a staff briefing regarding the City’s Wholesale Power Agreements and the cost recovery mechanism for wholesale power purchases. Council will also discuss the duties and responsibilities of the Presiding Municipal Court Judge.

FRAUD ALERT. The Cervini v. Stapp lawsuit relies on the City’s claim that it actually has
a Director of Public Safety, and when this fraud is discovered, and for this reason the City is full
tilt panic mode . Chase Stapp is NOT the "Director of Public Safety". No such title has exists in the
San Marcos municipal code. The City is in full tilt panic mode.
Stapp was removed as chief of police without approval from city council. How so? City Manager
Bert Lumbreras got into real trouble two years ago. He and Stapp were found giving aggravated
perjury to the state attorney general. They remain in trouble.
So Lumbreras next went to the council and asked them to remove Stapp but they refused. So two
days later, on August 27, 2019, Lumbreras put Stapp into a desk job at City Hall where Stapp remains
a commissioned police officer awaiting retirement. The Municipal Code of San Marcos contains no
mention of a "Director of Public Safety." The title was abolished by city council 30 years ago.

Lumbreras next generated a press release claiming that the council approved of Stapp’s new position.

Records of city council are silent to any removal of Stapp as chief of police, and are silent to any
appointment of Chase Stapp to this bogus position.

It's all about a coverup involving reduction of jail outsourcing costs. It’s about Lumbreras and Stapp
who by sheer incompetence pulled the curtain back on their own illegal operation. A certain person
recently brought these facts to my attention, and based on what I have determined of that person's
ability, I would not want to be in the City's shoes at this time. Hence for multiple reasons of law, our
new "chief" Stan Standridge is a real ringer.
Any wonder why Lumbreras recently announced his "retirement" , or why the 'positive accomplishments
that he recited at that time made it all sound like a sentencing hearing ?
This sounded crazy until I verified it using the links. Thanks. This city is out of control.
