San Marcos man arrested for involvement in breach of Capitol

A San Marcos resident who was allegedly employed by Infowars has been arrested for participating in the Jan. 6 Capitol riot.

According to documents from the U.S. Department of Justice, an investigation into Samuel Christopher Montoya began on Jan. 11. The FBI was tipped off when a family member of Montoya contacted authorities and told them he was inside the capital building recording a video.

The family member told the FBI that the video footage captured the death of Ashli Babbitt, a 35-year-old Air Force Veteran from San Diego who was shot and killed by police during the breach of the Capitol.

Authorities found a 44-minute video entitled, “Patriots Storm Congress Raw Footage Includes Execution of Ashli Babbitt,” where the narrator in the video identifies himself as, “Sam with Infowars.com,” which was posted on Jan. 6.

After the Capitol riot, Montoya showed the video to family members, where they recognized him when he turns the camera to himself and said, “It feels good to be in the Capitol baby!”

The lawsuit includes several statements Montoya made throughout the video, such as “I’m sure these officers are scared, but we’re here, we’re here to show that we‘ve had enough. We’ve had enough.” Montoya also narrates later in the video, “here we are in the U.S. Capitol in Washington DC in the Capitol building. It has officially been stormed by Trump supporters… And here we are, taking our – the people’s house back!”

According to the FBI, Montoya was interviewed on Infowars several times in the days following the breach of the Capitol to describe his experience. In the interviews, he is identified as Sam, a video editor with infowarsstore.com.

Although Montoya claims to be a journalist, the FBI confirmed with the Capitol press office that he did not have press credentials the day of the riot. FBI was able to locate Montoya at several locations inside the Capitol building on surveillance footage.

According to the U.S. Department of Justice, Montoya is charged with entering a restricted building, disorderly and disruptive conduct in a Capitol building, impeding passage through the Capitol, and “parading, demonstrating or picketing in a capitol building.”

Montoya was arrested on April 13 and had his first scheduled court appearance on April 14.

  • This is just wrong. The cops held the doors open, and the only person that died was killed by the government which she served. Congress got slapped in the face. Now we are going on yet another witch-hunt in order to "do something."

    Free Speech is not an absolute right. It is appropriate to make reasonable restrictions based on time & location. This is generally done for safety purposes. Such as, you're not supposed to be able to shut down roads & freeways to "protest." But again, the cops held the doors open. They were invited in.

    Mr. Montoya made a video that captured the death of Ashli Babbitt (evidence of possible crime). Family saw it and likely thought they were working with the government. Government turns on its people for having material that makes it look bad. Then covers it up by saying he didn't have a Right to "freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

    There is something very badly wrong here. We are living in the Twilight Zone. Its an unending series of insanity and the pace is quickening. The federal government is sick. We need to stop it. Stop playing the game. Rip off that mask. Take responsibility for yourself. They can't stop us all. Most cops won't even try.

      • Really, did you believe that the Government could close this whole country down 2 weeks before it happened. Never happened before. Did you think they could throw Japanese Americans in Concentration Camps on their own land. So many things happen through our Government that no one would believe, but yet you doubt anything that could be brewing and because someone brings it up the possibility the government could be over reaching, they are crazy!. No the things that the ruling class in office today are CRAZY and getting crazier by the day.

  • The supposed grievance is based on the lie that the election was stolen. You might have a point IF our government was in fact trampling on our rights. Attempting to stop the certification of a legitimate election is a crime. It is a wonder more did not die in this march. Trump doesn’t even believe it was stolen, but he made you believe it to satisfy his own objectives.

    • FYSA, BitCoin started surging immediately after the results were certified. It went up more than 10x, but is currently crashing. Transaction fees are spiking and the average Joe can't get out.

      All this while DPRK launch facilities are starting to unfreeze, Russia is on Ukraine's doorstep, China is pressuring Taiwan, and Iran... Well Iran doesn't really need an excuse. They all have a few things in common. A need for untraceable funding and a U.S. that won't/can't act.

      Hang onto your hat. Kamala's curtains might just save us.

  • Wow. Russia has roughly 150,000 personnel (and likely more within ops range) deployed to the Ukrainian boarder. That coincides with them announcing a 6-month long exercise in the Black Sea and the "return" of the U.S. Ambassador from Russia.

    The game is afoot. How far will it go?

  • AP is reporting, Russia is redeploying the majority of its troops back to their home bases. But they are leaving the "heavy equipment" 100 miles from Ukraine "just in case" they have to respond to protect Ukrainian citizens. -- That's the same reason Russia took Crimea.

    Maybe Putin will have Hillary press the big red button again.
