Buda Realtor, Jason Tarr, and his defense attorney, Billy McNabb, returned to court Monday, May 1, for the beginning sessions of the State of Texas vs. Tarr.
Monday’s court session focused on jury selection that started with 86 potential jurors that will be narrowed down to 12 jurors and an additional one – two as alternates.
The potential jurors were presented with a “bifurcate trial,” meaning two phase trial: guilty/innocent and punishment. If found guilty, Tarr has asked for a jury to decide his punishment.
By 2:00 p.m., presiding Judge Jack Robison had disqualified and/or dismissed 11 potential jurors.
Judge Robison said it is not the judge or the advocates, lawyers, to decide the facts of the case; the presiding judge merely ensures the law is followed. “The jury is the fact finder,” Robison said.
Jury selection will resume tomorrow at 9:00 a.m.
On Sept. 29, 2014, Tarr was allegedly driving while intoxicated on FM 1626 when his F150 Ford Pickup struck the vehicle of 60-year-old, Nancy Sterling-Dalton, head on. Sterling-Dalton was declared dead on the scene, and Tarr was taken into custody on Sept. 30, 2014.
Tarr was indicted for intoxicated manslaughter on Oct. 21, 2015. The defendant faces charges of murder and intoxicated manslaughter.
If found guilty for intoxicated manslaughter, Tarr could be sentenced to anywhere from two to twenty years in prison with probation. If found guilty for murder, Tarr could see anywhere from five to ninety-nine years.
