Three States Join Texas’ Lawsuit Against Fed Over Obamacare Tax

Texas Attorney General Ken Paxton has announced the states of Indiana, Nebraska and Wisconsin have joined Texas’ lawsuit challenging the validity of the Obamacare tax on state Medicaid managed care organizations.
“More states are realizing this is yet another example of the Obama Administration writing the law through bureaucratic rule-making, without any consideration for taxpayers or input from lawmakers or the states,” said Attorney General Paxton. “The pain is already being felt largely by middle-class wage earners, and now, the federal government is passing on additional taxes through the States. I will continue fighting to protect Texans from this unconstitutional tax funding the insolvent Obamacare mandate.”
The Obama Administration is threatening the Medicaid programs of the states if they refuse to pay an unconstitutional tax, which would total over $120 million annually in Texas.
Texas’ filed suit in October 2015, joined by the states of Kansas and Louisiana. To view the amended complaint, please visit:https://www.texasattorneygeneral.gov/files/epress/files/2016/019_First_Amended_Complaint.pdf
