Buda Reminds Residents About Fireworks Ordinance

With the New Year just around the corner, the City of Buda wanted to remind citizens that fireworks are prohibited in and around Buda.

Fireworks cannot be used/detonated in the city limits or within 5,000 feet of the city limits (Extraterritorial Jurisdiction).

Violation of the fireworks ordinance carries a fine not to exceed $500, with each occurrence being a separate violation.

Sec. 14.03.001 Penalty

Violation of this article and its provisions is a misdemeanor punishable by a fine not to exceed five hundred dollars ($500.00), with each occurrence being a separate violation. (Ordinance 940906-1, sec. III, adopted 9/6/94)

Sec. 14.03.002 Sale

The sale of all and any variety or type of fireworks is declared a nuisance and is hereby prohibited within the city limits and within five thousand (5,000) feet of the city limits. (Ordinance 2014-14 adopted 5/20/14)

Sec. 14.03.003 Detonation

It is hereby prohibited as a nuisance for any person, other than the city, to sell, use, detonate, or explode any type or variety of fireworks within the city limits and within five thousand (5,000) feet of the city limits without a public display permit meeting all the requirements of this section. A valid public display permit must be:

(1) Issued by the city fire marshal in accordance with section 10.02.009 of this code;

(2) For locations within five thousand (5,000) feet of the city limits; and

(3) For the use, detonation or explosion of fireworks to take place between sunset and 10:00 p.m. on July 4th (Independence Day).

Sec. 14.03.004 Defenses

It shall be an affirmative defense to prosecution under this article for a person to sell, use, detonate or explode any type or variety of fireworks within any portion of the 5,000-foot area described in sections 14.03.002 and 14.03.003 if located within the city limits or extraterritorial jurisdiction of any other municipal corporation.
