San Marcos P&Z Approves Lifetime CUP For Local Business

On Tuesday, the San Marcos Planning and Zoning Commission considered a Conditional Use Permits for a local restaurant and a proposed major restaurant chain location.

Commissioners considered requests by Wok and Roll and Cheddar’s Casual Café, Inc. for a mixed beverage permit for on-premise consumption of alcohol.

Wok and Roll is located near the intersection of South Guadalupe Street and Armstrong Street; the restaurant is approximately 3,375 square feet.

According to the agenda, the restaurant previous received a lifetime CUP for beer and wine in 2016.

Staff recommended approval with the following conditions:

  • Permit shall be valid for three (3) years, provided standards are met.
  • The permit shall be posted in the same area and manner as the Certificate of Occupancy.

Staff said the restaurant used to have an outdoor patio, which has since been removed, and the restaurant’s hours of operation are 11 AM to PM Monday through Saturday and 11 AM to 9 PM on Sunday.

Commissioner Travis Kelsey made a motion to approve the CUP as a lifetime permit with staff’s other recommendations.

Commissioner Chair Jim Garber said the restaurant would have to come back for a new CUP if they decided to add patio seating back in.

“We have to help the local people in this community, and these guys are great,” Kelsey said.
“They just remodeled and the place looks fantastic. I don’t think we need to add any more restrictions for them.”

Kelsey said local businesses in San Marcos “are falling like flies,” and he did not want to put any more restrictions on them.

“Let them run their business and do what they do best,” Kelsey said.

The Commission approved the CUP 8 to 0 with Commissioner Mark Gleason absent.

Cheddar’s Casual Café, Inc is proposing to build a location in San Marcos in the Stonecreek Crossing Planned Development District, which was approved in 2007, according to the agenda.

The site sits between Barnes Drive and the I-35 S Access Road.

The restaurant is proposed to be developed on the currently vacant lot and will consist of 7,482 square feet with 226 indoor seats and no outdoor. 

According to the agenda, Staff has reviewed the application with the requirements of the San Marcos Development Code and the Stonecreek Crossing PDD and recommends approval of the request with the following conditions:

  • Permit shall be valid for one (1) year, provided standards are met,
  • The permit shall be posted in the same area and manner as the Certificate of Occupancy.
  • The permit shall be valid upon the issuance of a Certificate of Occupancy.

Commissioners approved the CUP 8-0 with Gleason absent and no discussion.
