Drunk Driver, Who Killed Husband And Unborn Child, Pleads Guilty

A Texas State student charged with two counts of intoxication manslaughter and one count of intoxication assault with a vehicle pled guilty Monday, March 5.
Around 6 p.m. on Aug. 2, 2016, Kristian Nicole Guerrero, then 24, and her husband, Fabian Guerrero-Moreno, 23, were driving out of town when a Chevrolet Impala crossed the center line and crashed into them.
Fabian, who had been in the passenger seat, was killed, and Kristian, who was five months pregnant, was taken to St. David’s South Austin Medical Center for treatment of severe injuries.
The driver of the Impala, Shana Lee Elliott, then 21, was arrested and charged with one count of intoxication manslaughter and one count of intoxication assault.
A second charge of intoxication manslaughter was added after Guerrero’s injuries resulted in the loss of her unborn child.
At the time of her arrest, Elliott admitted to police she had been drinking while tubing on the river before the accident.
The jury will decide Elliot’s sentencing on Tuesday, March 6. Intoxication manslaughter is a second-degree felony in Texas; each count can have a fine of up to $10,000 and a prison sentence 2 to 20 years. Judge Jack Robison presides.
A Grand Jury indicted Elliott on Oct. 16, 2016.
Elliott was a senior at Texas State University studying public relations and mass communications when the accident occurred. She had two other arrests in Hays County from March 22, 2016, and May 2, 2016, for possession of heroin and methamphetamine.
