Kyle PD Arrest Man In Aggravated Assault Case

Kyle, TX – Kyle Police today arrested 28-year-old Kyle resident Daniel Zachary Gutierrez in a case that originally came in as a weapons concern last night.

According to the arrest affidavit, KPD charged Daniel Zachary Gutierrez with aggravated assault with a deadly weapon.

Police received a 911 call overnight regarding concern for a male subject who was in the street holding a gun in the 300 block of Thicket Lane. Witness reports indicate the male subject pacing around his own vehicle and screaming. He reportedly then took a handgun from his trunk and put it in his waistband.

Police said a second witness approached the man and asked if he was okay. At that point, the subject began yelling at the person, who then attempted to leave the area. However, the subject blocked the cul-de-sac with his vehicle. Police report that the subject then hit that person with his vehicle.

Following that, the suspect exited his vehicle, pointed the gun at the victim and was yelling. The male subject then left the area by vehicle. KPD reported that the victim followed the subject in a separate vehicle.

“The victim reported seeing the subject’s vehicle drive recklessly through the neighborhood,” a KPD official said. “KPD officers quickly located the subject who then pulled over and fled on foot in the area of Bunny Trail and Llama Loop.”

At some point, officers lost visual of the suspect. After an extensive check of the area, the subject could not be located. However, KPD’s investigation led them to Gutierrez, who was arrested at his residence earlier today without incident.

“I’m proud of the work conducted by KPD officers in this case,” KPD Police Chief Jeff Barnett said. “We are also appreciative of the assistance from Hays County Sheriff’s Office and the Texas DPS aircraft operations division.”
