Teenage Suspect In January Shooting Surrenders To Police

A 17-year-old accused of shooting two 18-year-old males after an argument late last month at the Whispering Oaks Community, 503 Uhland Road, has surrendered to San Marcos Police.

On Tuesday, Feb. 16, 2021, Octavius Garner (DOB 5/28/2003) of San Marcos, TX., flagged down an SMPD officer and turned himself in on active warrants for two counts of Aggravated Assault with a Deadly Weapon.

As of this release, Garner remains in the Hays County Jail on a $500,000 bond.

On Saturday, Jan. 30, 2021, the San Marcos Police Department responded to a shooting that occurred at the Whispering Oaks community, formerly Siesta Mobile Home Park, 503 Uhland Road.

Officers arrived at the scene and discovered two gunshot victims. An 18-year-old man found inside a car parked in front of a trailer suffered several gunshot wounds. Officers found another 18-year-old man down the street with a graze wound from a gunshot. Both victims were treated at Ascension Seton Hays Hospital in Kyle and are expected to survive.

An initial investigation conducted by SMPD revealed the victims were sitting inside the parked car with the suspect when an argument broke out.

The suspect, later identified as 17-year-old Octavius Garner (DOB 05/28/2003), pulled out a handgun and began shooting.

Garner was last seen running away from the Whispering Oaks community wearing a red hooded sweatshirt. Detectives believe he may have fled to Austin or Houston.

Detectives obtained a warrant for Garner’s arrest for two counts of Aggravated Assault with a Deadly Weapon. As of this release, SMPD has not located or arrested Garner.
