Gotta Habit Smoke Shop Shooter Back In Jail

Steven Carlos Hernandez (20) was indicted on Tuesday (January 6, 2015) for one count of Aggravated Robbery, a first degree felony, arising from an alleged armed robbery of the Gotta Habit Smoke Shop on September 21, 2014, during which a store clerk was shot and injured.

Hernandez was arrested on September 25, 2014, then released from custody on December 18, 2014, on a personal recognizance bond due to his having remained in custody for over 90 days without having been indicted.  After Tuesday’s grand jury handed down the indictment, Judge Bill Henry of the 428th District Court reinstated Hernandez’s previous bond at $75,000. Hernandez was taken back into custody today.  A trial date has not been set.

On September 21, 2014 the San Marcos Police Department had received a call reporting a man had been shot at the Gotta Habit Smoke Shop, located at 700 N. LBJ #113.
Hernandez had entered the store brandishing a pistol and was confronted by the victim, 25-year-old Patrick William Reilly. Reilly grappled with Hernandez and was shot in the chest during the robbery, according to police.
