UPDATE: Kyle Police Investigating Officer Involved Shooting

At that point, the officer fired his weapon into the vehicle. Barnett said the suspect then fled the scene. Other officers also engaged in the pursuit.

Kyle, TX – Kyle Police are investigating an officer involved shooting that occurred earlier this evening. KPD Chief Jeff Barnett said it started at approximately 7:15 p.m. when an officer attempted to stop a vehicle on suspicion of driving under the influence.

When the officer activated his emergency lights, the driver, who police identified as 20-year-old Javier Hernandez of Hays County, accelerated and attempted to flee from the officer. He then drove at a high rate of speed in a reckless manner through a residential neighborhood, disregarding multiple stop signs.

At one point, the driver narrowly missed hitting a pickup truck parked on the road. The driver also nearly hit another vehicle traveling perpendicular to his vehicle.

The officer then observed the suspect’s vehicle turn a corner and run off the road and into a ditch where he came to a stop. As the officer exited his patrol car, the suspect then reversed his vehicle in the direction of the officer, placing that officer in immediate danger.

At that point, the officer fired his weapon into the vehicle. Barnett said the suspect then fled the scene. Other officers also engaged in the pursuit.

“Another officer observed the suspect’s vehicle was on fire from underneath the carriage,” Barnett said. “The driver continued for a short time then came to a stop on Masonwood Drive where he was apprehended following a short foot chase.”

Both the officer and the suspect were uninjured, though as a matter of routine protocol, they were taken to local hospitals for observation.

“We are grateful that neither the suspect nor the officer were hurt during this incident,” Barnett said. “Our department is continuing to conduct a full investigation.”

Barnett said Kyle Police are charging Hernandez with Driving While Intoxicated, Evading Arrest or Detention with a Vehicle, Aggravated Assault on a Public Servant, and a second charge of Evading Arrest or Detention for fleeing the scene on foot. He will be booked into the Hays County Jail.
