TONIGHT: San Marcos P&Z Slated For A Night Of Public Hearings

The San Marcos Planning and Zoning Commission is slated for a night of public hearings tonight.

Commissioners will three Conditional Use Permit requests.

Ginger Sushi is requesting a CUP to allow for the sale and on-premise consumption of beer and wine.

The restaurant is located at 212 North LBJ Drive within the Central Business Area.

According to the agenda, the restaurant has indoor seating for 50 people and no outdoor seating.

Staff is recommending the approval with the following conditions:

  1. Permit is valid for one (1) year, provided standards are met;
  2. The permit is posted in the same area and manner as the Certificate of Occupancy.

Cheatham Street Warehouse is requesting a CUP for an expansion of service to allow the sale of mixed alcoholic beverages for consumption on the premises.

Cheatham Street Warehouse currently holds a lifetime CUP as of January 2014; live music is performed within the original Cheatham Street Warehouse on a regular basis and has been since 1974.

According to the agenda, the applicant is requesting to expand their service area, which will include a former thrift store, which will be renovated into a restaurant, and an area of the existing parking lot, which will become outdoor space.

Staff has reviewed the request with the San Marcos Development Code and recommends approval of the request with the following conditions:

  1. Permit shall be valid for one (1) year, provided standards are met;
  2. The permit shall be posted in the same area and manner as the Certificate of Occupancy;
  3. The permit for the expansion shall be valid upon the issuance of a Certificate of Occupancy;
  4. No amplified live music shall be allowed outdoors or in other unconditioned areas;
  5. The use of outdoor speakers shall be limited to between the hours of 11 a.m. and 11 p.m.; and
  6. The business shall be responsible for maintaining the sidewalk, gutters, parking lot, and all areas within 100 feet of any exit and all areas of the permitted property in a clean and sanitary condition, free from litter and refuse at all times.

Commissioners will also hold a public hearing and consider a request by Josh Clay with Kissing Tree Golf Club, LLC, on behalf of Brookfield Residential Kissing Tree LLC for the renewal of an existing CUP for the sale of mixed alcoholic beverages for on-premise consumption.

Kissing Tree Planned Development District, previously known as Paso Robles, was approved in 2008. The age-restricted community includes an 18-hole golf course, indoor and outdoor recreation facilities and community centers located on amenity lots.

The alcohol service boundary includes the golf holes, golf cart paths, and amenity center lot at 201 Kissing Tree Lane. Kissing Tree previously received approval for a Conditional Use Permit in 2017, which went into effect at the time of the Certificate of Occupancy.

Staff recommends approval of the Conditional Use Permit with the following conditions:

  1. Permit shall be valid for three (3) years, provided standards are met;
  2. The sale of alcohol for on-premise consumption is prohibited outside the limits of the service area boundary as shown on Exhibit A; and
  3. The permit shall be posted in the same area and manner as the Certificate of Occupancy for both the Golf Clubhouse and the Social Building.

San Marcos Planning and Zoning will convene in the City Council Chambers at City Hall at 6:00 PM this evening.
