Top Items To Watch During This Week’s San Marcos Planning & Zoning Meeting

ITEM 1.2. (Independence Trail Final Plat) Consider a request by Chan & Partners Engineering, LLC, on behalf of M&M Holdings, LLC, for approval of a Final Plat for approximately 72.942 acres, more or less, out of the John Owens Survey, consisting of 57 residential lots located near the intersection of Old Bastrop Highway and Francis Harris Lane. 

BACKGROUND: 

The subject property is approximately 72.94 acres out of the John Owens Survey, located on Old Bastrop Highway south of Francis Harris Lane in Hays County and within the City’s Extraterritorial Jurisdiction (ETJ). The property will be divided into 57 lots intended for residential development.

Water service will be provided by Crystal Clear Supply Corporation with infrastructure being extended through the development by the developer. Since each lot is over 1 acre, the properties can be served by on-site wastewater systems.

Staff has reviewed the request and recommends approval.

 

ITEM 1.3. (Hops & Grain) – Hold a public hearing and consider a request by Josh Hare, on behalf of Mark Shields, for a Conditional Use Permit to allow for the sale of beer and wine for on-premises consumption at 110 East MLK.

BACKGROUND: 

Hops & Grain is proposing to open a brewery and tasting room at 110 East MLK, at the rear of the former Hays County Justice Center. The proposed tasting room will face Guadalupe Street, and includes indoor and outdoor seating. The proposed tasting room occupies approximately 2,500 square feet.

The proposed hours of operation are 10 a.m. to 10 p.m. Monday – Sunday. The tasting room is proposed to seat 100 people, and the outdoor patio is proposed to seat 55 people. According to the provided site plan, there are 127 parking spaces in the parking lot and 14 on street parking spaces, for a total of 141 total parking spaces associated with this property.

Hops and Grain will have 20 off street parking spaces under their control, and may use all of the on street parking spaces as well. The parking for this business will exceed the code requirement. The applicant is proposing to limit live music to the interior of the building.

Staff provides this request to the Commission for your consideration and recommends approval of the Conditional Use Permit with the following conditions:

1.The CUP shall be valid for one (1) year, provided standards are met, subject to the point system;

2.The permit shall be effective upon the issuance of the Certificate of Occupancy; and

3.The CUP shall be posted in the same area and manner as the Certificate of Occupancy.

 

ITEM 1.4. (Blanco Park Replat) Hold a public hearing and consider a request by Byrn & Associates, on behalf of Ed Longcope, for approval of a replat of 7.53 acres, more or less, being Lot 1-A of Blanco Park Subdivision, establishing Lots 1-B, 1-C, 1-D, and 1-E, Blanco Park Subdivision, City of San Marcos, Hays County, Texas and associated Subdivision Improvement Agreement. 

BACKGROUND: 

The purpose of this plat is to replat one existing lot and establish 4 separate lots located inside the San Marcos City Limits. The replat consists of Lot 1-A, Blanco Park Subdivision, an amendment to the Blanco Park Subdivision, recorded in 2009. Lots 1-B, 1-C, and 1-D are zoned General Commercial (“GC”) and Lot 1-E is zoned Multifamily (“MF-18”). Lot 1-E is noted on the plat as a “Non-Buildable Lot” due to its location entirely within the floodway.

A wastewater line extension is required to serve Lot 1-C. The applicant has chosen to defer the construction of these public improvements until after the plat is approved. Per Section 1.6.6.3 of the Land Development Code (LDC), the property owner will enter into a subdivision improvement agreement when public improvements are deferred until after final plat approval.

This agreement includes, but is not limited to, provisions to complete the improvements, covenants to warranty the improvements, and provisions for securing the obligations of the agreement. Section 1.6.6.3 also states that the Planning and Zoning Commission is the governing body to approve the agreement. It has been reviewed for consistency with Section 1.6.6.3 and meets the criteria.

Staff has reviewed the request and finds the proposed replat and associated Subdivision Improvement Agreement meets all criteria of 1.6.6.3 and 1.6.8.2 of the LDC and recommends approval of the replat.

ITEM 1.5. Presentation and discussion concerning the transition and buffering requirements in Code SMTX. 

BACKGROUND: 

The purpose of this presentation is to provide information on the tools that are being introduced in the new land development code, Code SMTX, to ensure compatibility of new development with existing community character.

ITEM 1.6. Receive an update from Staff regarding the Fall 2017 Preferred Scenario Amendment. (W. Parrish)

BACKGROUND: 

One (1) application was received for the Fall 2017 Preferred Scenario Amendment (PSA) Deadline. 

A) SLF II – HWY 360 & Camp Wisdom LP & SLF II San Marcos LP & ET AL ::  +/-  95 acres located of North IH 35 and Champions Boulevard :: Proposal to change from Medium Intensity to Employment Center :: Proposal to change from General Commercial to Light Industrial.
