San Marcos P&Z To Hold Public Hearing On CUP For Gumby’s, Demolition Review Process

The San Marcos Planning and Zoning Commission is slated to hold two public hearings tonight.

Gumby’s Pizza will return before the Planning and Zoning Commission with a request for a Conditional Use Permit to allow for the sale of mixed beverages for consumption at 312 West Hopkins Street.

In 2016, Gumby’s applied for a CUP for alcohol sales at this location before the business was operational.

Commissioners voted December 13, 2016, to postpone a decision following citizen’s concerns with the request. The decision was postponed until January 2017 where the commission voted 5-1-1 to approve the request with the following conditions.

An appeal request for the CUP was filed on January 20, 2017, by Kathryn Dillon, and the San Marcos City Council voted on February 2 to approve the appeal and deny the CUP for the pizzeria.

The City of San Marcos staff is recommending the approval of the CUP with the following conditions:

  1. The permit shall be valid for one (1) year, provided standards are met;
  2. The permit shall be posted in the same area and manner as the Certificate of Occupancy;
  3. Live music shall not be allowed outdoors or in any unconditioned areas; and
  4. The applicant shall not apply for a Late Hours TABC permit.

Commissioners will also hold a public hearing and consider a recommendation to the City Council regarding a Development Code amendment to include a demolition review process for historic-age resources.

In September, the commissioners voted to postpone action on their recommendation until the October meeting.

The commission requested that an alternative ordinance be written without the designation process be included for the commission to discuss.

The San Marcos Planning & Zoning Commission convenes at 6:00 PM in the City Council Chambers at City Hall.
